This Privacy Policy explains how CollabCart Pty Ltd (ABN 24 670 191 465) (CollabCart, we, us, our) collects, uses, discloses, stores and handles personal information in connection with our website, platform, marketplace, carts, checkout experiences, seller tools, supplier tools and related services.
This Privacy Policy is drafted for CollabCart's Australian operations and is intended to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

1. What personal information we collect
The personal information we collect depends on how you interact with CollabCart. It may include:
- name, email address, phone number, delivery address, billing details and other contact information;
- account registration details, login details and account activity;
- order, cart, purchase, transaction, fulfilment, refund, return, dispute and support information;
- information about products you buy, receive, recommend, list, supply or interact with;
- recipient details where someone buys a product for another person;
- seller and supplier business information, including business name, ABN, GST status, role, contact details, verification details, tax information and payout information;
- bank account or payout details where needed to pay sellers, suppliers or other payout recipients;
- information provided in support requests, complaints, forms, messages, onboarding flows or communications with us;
- marketing preferences and communication preferences;
- technical and usage information, including IP address, device information, browser information, pages viewed, links clicked, session data, approximate location, analytics data, cookies and similar technology data; and
- any other information you provide to us or that we collect where reasonably necessary for our functions and activities.
We do not store full credit card information for customer purchases. Customer payments are processed through Shopify checkout and/or relevant payment providers.
2. Health, wellness and product-related information
CollabCart may sell or facilitate access to products that relate to health, wellness, lifestyle, testing, tracking, nutrition or similar categories. We may collect and store order information showing the products ordered, including where that information may reveal or imply health or wellness interests.
CollabCart facilitates purchase and fulfilment only. We do not provide medical advice, interpret results, provide treatment, or store product-generated information such as test results or tracker outputs.
For some products, additional details such as sex or date of birth may be required by a supplier or product provider to facilitate purchase, fulfilment or registration. Where we collect additional details such as sex or date of birth to facilitate the purchase or registration of a product, we use those details only for that purpose. We remove those additional details from the relevant order record 30 days after the order has been fulfilled, unless we are required or permitted by law to retain them for longer.
We may retain non-sensitive order records needed for accounting, support, refunds, disputes, fraud prevention, supplier reconciliation, reporting and legal compliance.
3. How we collect personal information
We may collect personal information:
- directly from you when you browse the site, create an account, place an order, create a cart, list products, apply as a seller or supplier, provide payout details, contact support or otherwise interact with us;
- from someone who buys a product for you or provides your details for delivery, fulfilment, registration or support;
- from sellers, suppliers, fulfilment partners, payment providers, Shopify checkout, analytics providers, embedded form providers, IT providers and other service providers;
- from cookies, pixels, analytics tools and similar technologies;
- from public sources, business registers or verification sources where relevant to seller or supplier onboarding, eligibility, compliance or fraud prevention; and
- from professional advisers, regulators, dispute bodies, banks, payment providers or other third parties where relevant to our business, legal or compliance functions.
If you provide another person's personal information to us, you must have their authority or consent to do so and must ensure they are aware of this Privacy Policy where appropriate.
4. Why we collect, use and disclose personal information
We may collect, use and disclose personal information to:
- operate, provide, administer, secure, improve and personalise CollabCart;
- create and manage accounts;
- process orders, checkout, payments, refunds, returns, chargebacks and disputes;
- facilitate product purchase, shipping, fulfilment, registration, tracking, supplier communication and customer support;
- share relevant order, delivery and customer details with sellers, suppliers, fulfilment partners and service providers;
- onboard, verify, approve, manage, pay, suspend or remove sellers and suppliers;
- calculate, administer, hold, adjust and pay commissions, supplier payments, fees and payouts;
- collect and retain payout, banking, tax, business, identity, transaction and compliance records;
- provide service-related communications, account notices, order updates, payout notices, legal notices, support messages and operational messages;
- send marketing or promotional communications by email, SMS or other electronic means where permitted by law;
- manage unsubscribe and communication preferences;
- analyse usage, measure performance, troubleshoot issues, improve products/services and understand platform engagement;
- detect, investigate, prevent and respond to fraud, misuse, security issues, circumvention, unlawful activity and platform integrity risks;
- moderate, review, edit, reject, remove or suspend products, carts, listings, content, accounts or activity;
- manage complaints, customer issues, seller/supplier disputes, privacy requests, legal claims and regulator enquiries;
- comply with tax, accounting, audit, reporting, recordkeeping, legal and regulatory obligations;
- obtain professional advice and manage business administration; and
- conduct any other purpose notified to you or permitted by law.
5. Who we disclose personal information to
We may disclose personal information to:
- suppliers, product providers, fulfilment partners, labs, logistics providers, carriers and other parties involved in fulfilling or supporting an order;
- the seller connected to the relevant cart or order;
- Shopify checkout, payment providers, banks and financial service providers;
- payout providers or banking partners used to pay sellers, suppliers or other payout recipients;
- IT, hosting, security, analytics, forms, communication, customer support and business operations providers;
- professional advisers, including accountants, lawyers, insurers, consultants and auditors;
- regulators, courts, tribunals, law enforcement, government agencies, dispute resolution bodies or other parties where required or permitted by law;
- prospective purchasers, investors, advisers or parties involved in a business sale, merger, restructure, financing or due diligence process; and
- any other person where you authorise us or where disclosure is required or permitted by law.
We do not sell personal information to third parties for their own marketing purposes. Sellers and suppliers who receive customer/order information through CollabCart are required to use it only for permitted CollabCart-related, order, support, compliance or legally permitted purposes, and to comply with privacy, spam, consumer and data protection laws.
6. Supplier and seller communications with customers
Order-related contact should generally occur through CollabCart. Relevant sellers may receive customer/order details connected to their carts and may use those details only as permitted by CollabCart terms and applicable law.
Suppliers may receive customer or recipient details and may contact customers directly where needed for fulfilment, shipping, product support, product registration, safety/recall issues or related order purposes.
Sellers and suppliers must not use CollabCart customer/order information for unrelated marketing, off-platform solicitation or other unrelated purposes unless they have a separate lawful basis and comply with applicable laws.
7. Payments and payout details
Customer payment/card details are handled through Shopify checkout and/or relevant payment providers. CollabCart does not store full credit card information.
We may collect and retain bank account, payout, tax and business details from sellers, suppliers or other payout recipients where needed to process payouts, verify accounts, administer commissions, meet tax/accounting obligations, prevent fraud, resolve disputes and comply with law.
8. Cookies, analytics, pixels and similar technologies
We may use cookies, pixels, analytics tools and similar technologies to operate the site/platform, remember preferences, manage authentication and sessions, support security, measure usage and performance, troubleshoot issues, improve products/services, and support marketing or advertising where permitted by law.
We use PostHog, a product analytics service, to understand how the site and platform are used - for example which pages are visited, which features are used, and interactions such as clicks and form activity. PostHog also allows us to replay a sample of user sessions so we can diagnose problems and improve usability. Session replays mask everything typed into input fields by default - passwords, addresses and similar details appear only as masked placeholders - and payment card entry happens inside our payment provider's own secure frame, which is not captured at all.
Analytics data is processed for us by PostHog, Inc. and stored in the United States (see section 13, Overseas disclosures). Where you are signed in, analytics data is linked to your account so we can provide support and improve your experience; otherwise it is associated with an anonymous identifier.
We may also use other tools such as embedded third-party forms (for example Tally). We may change providers or technologies over time.
You may be able to control cookies through your browser or device settings. Disabling cookies may affect platform functionality.
9. Marketing and communications
We may use your contact details to send you service-related communications, updates about your account, orders, payouts, supplier or seller activity, and, where permitted by law, marketing communications by email, SMS or other electronic means.
You can unsubscribe or opt out of marketing communications at any time. We may still send you non-marketing messages that are necessary for your account, orders, transactions, support, platform operation or legal compliance.
10. Storage and security
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.
No system is completely secure. You are responsible for keeping your login credentials secure and notifying us promptly of suspected unauthorised access.
11. Retention and account closure
We retain personal information for as long as reasonably necessary for the purpose collected, or as required or permitted by law.
If you close your account or request deletion, we may retain information needed for existing or completed orders, fulfilment, customer support, refunds, returns, payouts, tax/accounting, chargebacks, fraud prevention, dispute handling, legal compliance, audit records, legitimate business records and platform integrity.
Seller/supplier payout details, tax/business records, identity/verification information, transaction records, order records, commission records, chargeback records and dispute/compliance records may be retained after account closure where required or permitted by law or needed for legitimate business purposes.
12. Access and correction
You may request access to personal information we hold about you, or ask us to correct it if it is inaccurate, incomplete or out of date, by contacting support@collabcart.com.
We may need to verify your identity before responding. We may refuse or limit access or correction where permitted by law.
13. Overseas disclosures
Some service providers we use may store, access or process information outside Australia. Where this occurs, we will take reasonable steps required by Australian privacy law in relation to overseas disclosures.
14. Third-party sites and services
CollabCart may link to or integrate with third-party sites, tools, forms, checkout experiences, payment providers, supplier systems or other services. Those third parties may handle personal information under their own terms and privacy policies. You should review those policies where relevant.
15. Complaints
If you have a privacy complaint or concern, contact support@collabcart.com with details of the issue. We will try to resolve privacy complaints in good faith. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner at www.oaic.gov.au.
16. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. Updated versions take effect when posted on the site unless stated otherwise. You should review this Privacy Policy periodically. We may notify users of material changes where appropriate, but are not required to notify every update unless required by law.
